Copyright policy

The publications of the Universidad Católica Luis Amigó are open access and are available in the microsite of its Editorial Fund, however, the Institution reserves the patrimonial rights -that is, the way in which such works will be used-, according to the copyright laws and the terms and conditions of the Creative Commons Attribution-NonCommercial-NoDerivs 4.0 International License.

Regulations

Editorial products are subject to the following international, national and institutional standards and policies.

  • Law 33 of 1987 (October 26) - Approving the "Berne Convention for the Protection of Literary and Artistic Works" of September 9, 1886, completed in Paris on May 4, 1896, revised in Berlin on November 13, 1908, completed in Berne on March 20, 1914 and revised in Rome on June 2, 1928, in Brussels on June 26, 1948, in Stockholm on July 14, 1967 and in Paris on July 24, 1971.
  • WIPO Copyright Treaty, adopted by the Diplomatic Conference on December 20, 1996. World Intellectual Property Organization - Geneva.
  • Law 44 of 1993. Whereby Law 23 of 1982 is amended and supplemented and Law 29 of 1944 is amended.
  • Law 98 of 1993. Whereby norms on democratization and promotion of the Colombian book are dictated.
  • Law 719 of 2001. Whereby Laws 23 of 1982 and 44 of 1993 are amended.
  • Decree 460 of 1995 (March 16). By which the National Registry of Copyrights is regulated and the Legal Deposit is regulated.
  • Intellectual Property Statute.

Permissions and licenses

By means of Creative Commons licenses, located on the credits page of each of its publications, the Fondo Editorial Universidad Católica Luis Amigó specifies that others may download the works and share them, but establishes the following limits as holder of the Patrimonial Rights:

  • Any use of the work must indicate authorship, in other words, it will have as a condition the acknowledgment (attribution).
  • In no case the exploitation of the work for commercial purposes is allowed; in other words, its use is restricted to non-commercial.
  • The creation of derivative works is not authorized; that is, the transformation of the publications will be exclusive to the Fondo Editorial Luis Amigó or to the person or Institution authorized by it; thus, the products of said Fund have the category of no derivative works.

Thus, the works are available with some rights reserved, so that any permission related to the above described, will be covered as described below:

Citations and references

The content of publications may be used as long as no more than 10% of the total document is reproduced verbatim, including tables and figures. In any case, the authorship, the page number where the information used is located and the other data required by the citation systems must be mentioned; regarding references, the editor must be mentioned: Fondo Editorial Universidad Católica Luis Amigó.

Translate

The translation of fragments is authorized only for cultural and/or academic purposes, under the same terms described for citations and references.

Photocopy

Chapters, individual articles or other components of publications may be photocopied, as long as they do not exceed 10% of the total content of the work and are made only for personal use, as permitted by copyright laws. Any photocopying for commercial purposes must be authorized by Universidad Católica Luis Amigó.

Storage and use

The publications of the Fondo Editorial Universidad Católica Luis Amigó may be downloaded in the original format in which they were published, but any reproduction of the material or copy stored in retrieval systems, repositories, libraries, virtual courses or websites of any kind, must be previously authorized by the Universidad Católica Luis Amigó.

Building on the work - derivative products

Videos, events, audiovisual formats, analog or digital books, and any other product derived from the publications, articles or material of the Fondo Editorial Universidad Católica Luis Amigó, with the exception of the aforementioned, must have the written authorization of the Institution.

Commercialize

No third party is allowed to commercialize the publications or material of the Fondo Editorial Universidad Católica Luis Amigó without prior authorization from the Institution.

Author's rights

The author or authors may have additional rights according to the agreements established between them and the publisher in the assignments, contracts or agreements.

Clarification: The Editorial Fund of the Universidad Católica Luis Amigó ensures respect for copyrights through the use of technological tools that allow the identification of possible copies and plagiarism; however, the authors are morally and legally responsible for the content of their publications, as well as for the respect of the rights mentioned. Therefore, the University is not responsible for damages to the good name or injuries and/or damages resulting from violations of intellectual property rights, industrial or privacy.

For licenses or authorizations

Send your request to the e-mail fondo.editorial@amigo.edu.co, indicating:

  • Title of the work or product you are interested in.
  • Use you will give to the material.
  • Means in which the material will be used. Period of time you will use the material.
  • Natural or legal person who will use the material. If it is a legal entity, what is the business sector.
  • Requests for licenses or authorizations will be reviewed by the Editorial Board of the Universidad Católica Luis Amigó.

In case of violation of these policies

By administrative, civil or criminal means, the Universidad Católica Luis Amigó may demand compensation for damages caused by those acts that violate the provisions of the policies described above; all within the Copyright Protection and the rules that regulate it.
