Abstract

The analogy of the title of this article, with the splendid novel “Love in the Time of Cho-lera” by the great Gabriel García Márquez is no coincidence. We wanted this respectful reference because as this work of literature, which projected the idea of love, fidelity, and death, in an dynamics that has evolved through time, inserted in the circumstances, in the ups and downs of personal life and social life have brought through history, it allows us to recognize that the right of property, must be analyzed according to these changes in collective life, solidified by constitutional principles and legal provisions that give us the vision of nations with respect to its foundations, riches and forms of internal and external relationships. Today the right of property is located in the midst of a political vision pre-ponderantly capitalist, global and oil dependant, which that has led Mexico to consider hydrocarbons as an issue of public utility and social benefit over any other particular activity, a circumstance that compels us to consider and analyze this conception that en-tails the limitation and dismemberment of the powers inherent in the law of real property.
