Abstract

The article begins with an introduction to describe, in broad terms, the problematization that led to the investigation of critical positions on the scientific status of Law, as well as explaining the reason to include Julius Hermann Von Kirchman´s ideas presented in the nineteenth century. This position will work as a source of indiscipline in legal knowledge, requiring a presentation of both theoretical reference of both indiscipline and science categories. This paper is based on mixed research paradigm, favoring the qualitative model, under a historical hermeneutical approach, which allows the researcher to mix doctrines along with Kirchman´s original criticisms on Law, especially those that consider that Law opposes knowledge progress since it analyzes current reality with past categories, which could be considered dead. The lawyer´s job seems to be limited to making comments on the judicial science, since he or she generates dissociation between the juridical feeling of the people and Law is controlled by judges and lawyers.
