Abstract

Informed consent, rather than a document is a dynamic process of vital importance in the construction and strengthening of the patient medical relationship, a fact that is even more important in the area of psychiatry, where the elements of judgment and reasoning of each patient in particular, can vary significantly, and in many cases the support of the social and family network of the same is required to consent to the different treatments. The objective of this article is to review the basic operational foundations in obtaining informed consent, and after that a review of the legal framework that regulates this practice in the Republic of Colombia. The author relates the concepts in the review of two jurisprudence of medical responsibility where informed consent plays a crucial role in the verdict, and the events reported are reviewed in the light of the fundamental concepts that support the practice.
